EU workplace protections for 30+ million of LGBTIQ+ people, the equivalent of several EU member states combined, remain fragmented and incomplete across member states. While the EU’s Employment Equality Directive prohibits discrimination based on sexual orientation in employment, it fails to cover gender identity or expression. This legal gap leaves transgender and non-binary employees exposed to inconsistent protections, a reality that undermines not only their safety and dignity but also business continuity, talent retention, and Europe’s competitive edge.

Even where legislation exists, its implementation varies significantly. Some countries, like Czechia, offer only minimal compliance, while others, such as Belgium or Spain, provide more robust national safeguards. The result? A patchwork of rights that fails to offer equal protection for all.
In response, forward-thinking companies are stepping up, going beyond minimum legal standards with internal policies that fill the legislative void. These businesses aren’t just ticking boxes. They’re building secure, inclusive environments where psychological safety fuels innovation, productivity, and sustainable growth.
